Here's the final update I hope helps others to avoid this issue. Maxell tech finally got back to me ( via phone) and basically stated that they do not have a solution and are aware of the problem but

The short answer is no you cannot. as you said it only resumes where it last left off. If has no way to know where you would like it to resume.
